While a divorce can involve a variety of issues, one of the most contentious is often marital property division. At Johnson, Johnson, & Nolan, Attorneys at Law, our goal is to help you come to a fair and favorable distribution of your marital assets and debt.

At Johnson, Johnson, & Nolan, Attorneys at Law, we look forward to building a relationship with each of our clients. We can help you resolve the issues of divorce-related property division through creative problem solving and aggressive negotiation.

Our attorneys can help you equitably and favorably resolve property division and the assignment of marital debt in divorce. After serving Belleville and the Illinois Metro-East region for five generations, our firm has the experience and skill to assist you in the division of:

  • The marital home and other real property
  • Professional practices and family-owned businesses
  • Retirement plans, pensions and 401(k) plans
  • Stock and investment portfolios
  • Government and military benefits divided by QDROs
  • Marital debt such as mortgages, car loans and credit card debt

Developing Fair Solutions in Marital Property Division

We will assist with the classification of your assets as marital and non-marital property, obtain a fair valuation of every asset, and negotiate for a fair distribution of assets and debt. We can help you work out a plan for occupancy of the marital home and how the proceeds will be divided if the home is sold. We will advise you on any tax implications of your property division agreement, consulting with experts when necessary. The agreement we help you reach will be made part of your overall marital settlement agreement and divorce decree.

If there is a question about whether a particular asset should be considered marital property subject to property division, we can assist you in gathering evidence to demonstrate its accurate classification. If a fair settlement cannot be reached, we will advocate forcefully for you in court.

What are your property division needs? Johnson, Johnson, & Nolan, Attorneys at Law looks forward to helping you. Contact us to arrange your free consultation.
