Can I amend my prenup after getting married?

In Illinois, you are able to amend your prenuptial agreement after you get married, according to the Illinois General Assembly. In order to have your prenuptial agreement amended, you and your spouse will need to sign a written contract. If you live in Belleville, or elsewhere in the state, it is crucial to understand the requirements surrounding prenuptial agreements, or any other type of family law matters you are dealing with.

When couples tie the knot, they may decide to sign a prenuptial agreement to protect their assets or serve another purpose. However, some couples may regret signing a prenup after their marriage or wish to change certain elements of the agreement. Fortunately, this is possible, so long as your spouse agrees to the modifications and is willing to sign their name. In fact, you can also have your prenuptial agreement revoked after you are married. To revoke your prenup, both you and your spouse must sign a written contract. The ILGA states that the revocation or amendment of a prenup is enforceable in the absence of consideration.

From modifying prenuptial agreements after the wedding ceremony to creating a prenup long before the marriage date, it is very important for you and your partner to approach prenups (and all other legal issues related to marriage) properly. Unfortunately, some people have failed to think ahead, which may come back to haunt them years later, or create unnecessary complications that could have been avoided.
